Terms of Service

By using Bernardbot at bernardbot.com you agree to these terms. If you don't agree, don't use it. If you're setting Bernardbot up for a child, you're agreeing on their behalf too.

You must be 13 or older to have your own Bernardbot login. A child under 13 can be a student on Bernardbot, but only through an account a parent or guardian creates and manages — the parent holds that account and is responsible for it. If you're under 18, a parent or guardian must agree to these terms along with you.

Keep your sign-in details to yourself and your account information accurate. You're responsible for what happens under your account. Email hello@bernardbot.com if you think someone else has got into it.

Bernardbot is in beta and free. That means features change, things break, data can be lost, and there is no uptime guarantee. If we ever start charging, we'll tell you before it happens and you'll be able to decline.

Bernard is an assistant. It reads photos and messages with AI and turns them into assignments and due dates. AI makes mistakes. It can misread handwriting, miss an item on a whiteboard, or attach the wrong date.

Bernardbot is not the official record of anything — your school's assignments, deadlines and grading policies are. Check anything that counts. We're not responsible for missed work, missed deadlines, or grades. Bernardbot is not tutoring, counseling, or medical, educational, or legal advice.

Photos, messages, class lists and assignments you put into Bernardbot stay yours. You give us permission to store, display and process that content only as far as it takes to run the service for you and the family members linked to your account — which includes sending it to the AI provider that reads it. That permission ends when the content is deleted.

Don't upload other people's personal information without permission, other students' work, copyrighted material you don't have the right to share, or anything unlawful. Photograph the whiteboard, not the classroom.

A student's account can be linked to parents or guardians. An active parent link can see that student's classes, assignments, check-in history and uploads, and can receive email summaries. Either side can end a link from Settings; after that the parent stops seeing new activity and stops getting email, but what was already recorded stays on the student's account. Invitations go out by email and expire — only send one to someone you actually want to have access.

Don't break the law with Bernardbot, try to reach another family's data, probe or overload our systems, scrape it, resell it, reverse-engineer it, or use it to harass anyone. And don't use it to cheat where your school forbids it — that's between you and your school, but we'd rather not be the tool.

Bernardbot runs on Clerk, Convex, Google, Amazon Web Services, Resend and Vercel. Their outages are our outages, and their terms apply to their part of the pipeline.

The Privacy Policy explains what we collect, why, and how to have it deleted. It's part of these terms.

You can stop using Bernardbot at any time, and email hello@bernardbot.com to have the account deleted. We can suspend or close an account that breaks these terms, or that we reasonably believe puts other families or the service at risk. If we close an account without cause, we'll try to give notice and a way to get the data out first.

We'll update these terms as the product changes; the date at the top says when. If a change is significant we'll email you before it takes effect. Using Bernardbot afterwards means you accept the new version.

Bernardbot is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We don't promise the service will be uninterrupted, secure or error-free, or that what Bernard pulls out of a photo will be correct.

To the fullest extent the law allows, Bernardbot and everyone working on it is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, missed assignments, or academic consequences. Our total liability for any claim relating to Bernardbot is capped at the greater of what you paid us in the twelve months before the claim — during beta, zero — or one hundred US dollars.

Some places don't allow these limits. Where that's true, they apply only as far as the law allows.

If someone brings a claim against us because of how you used Bernardbot or what you uploaded, you agree to cover the reasonable costs of dealing with it.

These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Illinois, and we both agree to that venue.

These terms and the Privacy Policy are the whole agreement between us. If a court strikes part of it, the rest stands. Not enforcing something once doesn't waive it. You can't transfer these terms to someone else; we can, if Bernardbot changes hands.
